This website is operated by Anna Semiguk, registered as an autónomo in Spain (NIF: ESZ0380607P), with place of business at Calle Jaén, 1, 1E, Rincón de la Victoria, Málaga, Spain, trading as aiproduction.io (hereinafter referred to as “we”, “us”, or “our”). Throughout this site, the terms “we”, “us”, and “our” refer to aiproduction.io.

 

By accessing aiproduction.io, you agree to be bound by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using or accessing this website or any services provided through it.

These Terms of Service govern your use of the website and the informational content available on it. The specific terms, pricing, deliverables, and conditions applicable to any individual project are set out in a separate invoice and/or service agreement issued directly to the client following the preparation and approval of a project quote. In the event of any conflict between these Terms and a signed agreement or invoice, the signed agreement or invoice shall prevail.

We reserve the right to update or amend these Terms of Service at any time. Changes take effect immediately upon publication on this page. Your continued use of the website following any changes constitutes your acceptance of the updated Terms.

  1. Business Purpose of Services

All services offered by Anna Semiguk / aiproduction.io are intended exclusively for commercial, business, professional, marketing, advertising, or promotional use. By engaging our services, the client represents and warrants that they are acting in connection with a business, professional, commercial, or entrepreneurial activity and not as a consumer purchasing services for personal, family, or household purposes.

  1. Acceptance of Terms

Acceptance of a quotation, payment of an invoice, email confirmation, electronic communication, or commencement of cooperation shall constitute full and unconditional acceptance of these Terms of Service. No separate signature is required for these Terms to be legally binding.

  1. Use of This Website

By using this website, you warrant that you will not:

  • Modify, copy, reproduce, prepare derivative works of, or reverse engineer any materials, content, or software contained on this website
  • Remove any copyright, trademark, or other proprietary notices from any materials on this website
  • Use this website or its content for any unlawful purpose or in violation of any applicable laws or regulations
  • Transmit or publish any harassing, fraudulent, obscene, or unlawful material through or in connection with this website
  • Use this website to send unauthorized advertising or spam
  • Harvest, collect, or gather any data or content from this website without our prior written consent
  • Attempt to gain unauthorized access to any part of this website or its related systems
  • Infringe upon the intellectual property rights, privacy rights, or other rights of any third party

 

  1. Informational Nature of Website Content

All content published on aiproduction.io — including descriptions of services, pricing indications, process descriptions, portfolio materials, and any other information — is provided for general informational purposes only. Nothing on this website constitutes a binding offer, contract, or guarantee of specific results.

Final project scope, deliverables, pricing, timelines, and terms are established and confirmed exclusively through an individual invoice and/or service agreement issued to the client after the quote has been prepared and approved by both parties. No engagement shall be deemed confirmed until such invoice or agreement has been issued by us and accepted by the client.

  1. Intellectual Property — Website Content and Portfolio

All content on this website, including but not limited to text, graphics, images, video materials, portfolio works, production concepts, visual identities, and design elements, is the intellectual property of Anna Semiguk and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view and access the content on this website for personal, non-commercial informational purposes only. This license does not constitute a transfer of title or ownership of any content.

You may not reproduce, copy, distribute, publish, transmit, display, sell, or commercially exploit any content from this website without our prior written permission. Unauthorized use of any content from this website may result in legal action.

  1. Intellectual Property — Delivered Works

Upon receipt of full payment for a project, the client is granted the rights to the final delivered video materials as specified in the applicable invoice or service agreement.

Notwithstanding the above, Anna Semiguk / aiproduction.io retains the right to display completed works in its portfolio, on the aiproduction.io website, and across its social media channels, unless the client has expressly requested otherwise. Should the client wish to restrict the use of their project materials in our portfolio, this must be agreed upon separately in writing and may be subject to an additional fee as compensation for the restriction of our promotional rights.

We retain ownership of all underlying creative processes, production methodologies, AI prompts, workflow systems, and technical approaches used in the creation of any delivered work. The client acquires rights to the final deliverable only, not to the methods or tools used to produce it.

No intellectual property rights in the delivered materials are transferred to the client until all invoices relating to the project have been paid in full. Until full payment is received, all delivered materials remain the exclusive property of Anna Semiguk.

  1. Prohibition on Reverse Engineering

The client acknowledges that our production process, including but not limited to AI prompting strategies, workflow structures, platform combinations, technical parameters, and creative methodologies, constitutes proprietary and confidential information.

The client agrees not to attempt to reverse engineer, reproduce, imitate, decode, or otherwise replicate our production process, prompts, or technical methods, whether directly or by engaging third parties to do so. Any breach of this clause may result in legal action and/or termination of the service agreement without refund.

  1. Client-Provided Materials

Where the client provides materials for use in the production process — including but not limited to product images, logos, brand assets, trademarks, text, or other content — the client warrants and represents that:

  • They are the rightful owner of all such materials or hold all necessary licenses and permissions to provide them for use in the project
  • The use of such materials in the production of the requested video content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
  • All product claims, descriptions, and brand representations included in the provided materials are accurate and comply with applicable advertising standards and regulations

 

The client accepts full and sole liability for any claims, damages, or legal proceedings arising from the use of client-provided materials. Anna Semiguk / aiproduction.io shall not be held responsible for any third-party claims resulting from content, assets, or instructions provided by the client.

 

  1. Project Cancellation and Prepayment

All projects require a prepayment as specified in the individual invoice or service agreement. This prepayment secures the commencement of work and the allocation of production resources.

In the event that the client cancels a project after work has commenced, the prepayment is non-refundable. The specific prepayment amount and conditions are set out in the applicable invoice or service agreement.

If aiproduction.io is unable to complete a project due to reasons within our control, any unused portion of the prepayment will be refunded to the client on a pro-rata basis.

  1. Revisions and Amendments

Each project includes two (2) rounds of revisions at no additional charge. A “round of revisions” is defined as a single, consolidated list of feedback submitted by the client following their review of the delivered materials. All revision requests within a single round must be submitted together in one communication.

Revision requests may not be used to substantially change the original approved brief, concept, script, style, product, or creative direction. Such changes will be treated as a new project scope and quoted separately.

Revisions submitted in separate communications following a round of feedback, or revisions that introduce new creative directions not present in the original brief, will be treated as a new round of revisions and billed accordingly.

Revision requests beyond the two included rounds will be subject to an additional fee, the amount of which will be agreed upon in writing between the parties prior to commencement of additional work.

  1. Acceptance of Deliverables

Delivered materials shall be deemed accepted if no written objections are received within five (5) calendar days following delivery. After this period, the delivered materials will be considered approved and accepted by the client in their delivered form.

Any claim arising out of a project must be submitted in writing within ten (10) calendar days following delivery of the final materials. Claims submitted after this period will not be considered.

  1. Force Majeure

Anna Semiguk / aiproduction.io shall not be held liable for any delay or failure to deliver services resulting from circumstances beyond our reasonable control, including but not limited to:

  • Outages, technical failures, or changes to third-party AI platforms and tools used in production
  • Internet service disruptions or infrastructure failures
  • Natural disasters, pandemics, or other force majeure events
  • Changes in applicable laws or regulations that affect the delivery of services
  • Any other event beyond the reasonable control of Anna Semiguk / aiproduction.io

 

In the event of a force majeure situation, we will notify the client as soon as reasonably practicable and will make reasonable efforts to resume delivery of services as quickly as possible. Agreed timelines may be extended accordingly without penalty.

 

  1. AI-Generated Content — Disclaimer

The client acknowledges that AI-generated content may contain imperfections, inconsistencies, visual artifacts, unexpected outputs, or variations that are inherent to the nature of current AI technology. Anna Semiguk / aiproduction.io applies professional direction, quality control, and cinematic standards to minimize such occurrences, but cannot guarantee that delivered materials will be entirely free from such characteristics.

We do not guarantee that AI-generated content will be entirely free from visual inaccuracies, platform-specific artifacts, or future third-party intellectual property claims arising solely from the operation of AI tools used in production. Anna Semiguk / aiproduction.io shall not be liable for any such claims arising from the inherent characteristics of AI-generated content where professional standards of care have been applied.

  1. Subcontractors and Third-Party Providers

We may engage employees, subcontractors, freelancers, or third-party service providers in the performance of services. Anna Semiguk / aiproduction.io remains responsible to the client for the delivery of services in accordance with the agreed scope and these Terms, regardless of any subcontracting arrangements.

  1. Right to Refuse or Terminate a Project

We reserve the right to refuse, suspend, or terminate any project at our sole discretion where the requested content, conduct, or circumstances may expose us to legal, ethical, or operational risk, including but not limited to requests involving unlawful content, deceptive advertising, infringement of third-party rights, or violation of platform policies.

In such cases, any work completed up to the point of termination will be billed on a pro-rata basis. The prepayment will be applied against any amounts due.

  1. No Guarantee of Business Results

While we are committed to delivering the highest quality cinematic AI video production, we do not guarantee any specific marketing, sales, engagement, conversion, ranking, or other business outcomes arising from the use of delivered materials. Results depend on factors beyond our control, including platform algorithms, market conditions, audience behavior, and client-side distribution strategies.

  1. Disclaimer of Warranties

This website and all materials and information contained on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, aiproduction.io makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the website or any part of it at any time without notice.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, aiproduction.io, its owner, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use this website
  • Any reliance on information published on this website
  • Any errors, inaccuracies, or omissions in website content
  • Any interruption, suspension, or termination of the website or services
  • Any third-party content or services linked from this website

 

In no event shall our total aggregate liability arising out of or relating to any project exceed the total amount actually paid by the client for the specific project giving rise to the claim.

 

In jurisdictions where limitations on liability are not permitted, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

This website may contain links to third-party websites. We are not responsible for the content, accuracy, or privacy practices of those sites. The inclusion of any link does not imply endorsement or approval by aiproduction.io. Use of any linked site is at your own risk.

  1. Privacy

We reserve the right to suspend or terminate your access to this website at any time and without notice if we determine, in our sole discretion, that you have violated any provision of these Terms of Service.

  1. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Spain. For clients based in the European Union, mandatory consumer protection provisions of the client’s country of residence shall also apply where required by applicable EU law.

For clients based in the United States, these Terms shall be interpreted in accordance with Spanish law to the extent permitted, and any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain, unless otherwise required by applicable mandatory law in the client’s jurisdiction.

Both parties agree to first attempt to resolve any dispute amicably through direct communication before initiating formal legal proceedings.

  1. Entire Agreement

These Terms of Service, together with our Privacy Policy and any individual invoice or service agreement issued to a client, constitute the entire agreement between you and Anna Semiguk / aiproduction.io with respect to the use of this website and the provision of services. These Terms supersede any prior communications or agreements, whether written or oral.
